Social Security disability benefits can be paid under two programs: The
Social Security Disability Insurance (SSDI) benefits program and the Supplemental
Security Income (SSI) benefits program.
Eligibility for Social Security Disability (SSDI) is based on prior work
history under Social Security and is available for individuals who have
worked in recent years and are now disabled. Supplemental Security Income
(SSI) eligibility is based on financial need, not on whether the applicant
has worked in the past, The medical requirements for both SSDI and SSI
are the same. You must have physical and/or mental impairments severe
enough to keep you from working in any regular paying jobs for a least
12 consecutive months. Disability due to drug and alcohol addiction is
not covered.
It is normal to be denied benefits upon initial application. You should
not be discouraged if you are denied as it is our experience this happens
in the vast majority of cases. You have sixty days from the time you are
denied to file your appeal. Please contact our office for a free review
of your case if you are denied and we will provide you with a careful
analysis of your claim. We handle most Social Security cases on a 25 %
contingent fee basis and provide a free initial consultation.
